These Terms of Service apply to the Vanguard C4 software family, including SkyPilot, GI SCOUT, NORDEN II, KEYFORGE, related documentation, and associated 3D aircraft and ordnance model libraries (collectively, the “Software”). By downloading, installing, accessing, or using the Software, you agree to these Terms.
1. License
Ken Johnson grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Software for lawful personal and virtual-squadron activities. The Software is licensed, not sold. No ownership rights are transferred to you.
2. Restrictions
You may not sell, sublicense, redistribute, commercially exploit, remove ownership notices from, or falsely claim ownership of the Software or its assets. You may not reverse engineer or attempt to obtain source code except where applicable law expressly permits it. You may not use the Software to violate law, interfere with systems, harass others, or compromise another person’s data or account.
3. Intellectual Property
The Software, documentation, interface designs, branding, graphics, audio, and supplied 3D aircraft and ordnance models are owned by Ken Johnson or used under applicable permission. All rights not expressly granted are reserved. Third-party names and marks remain the property of their respective owners.
4. User and Squadron Data
You are responsible for the information you enter, import, share, synchronize, or store. Some applications operate locally; GI SCOUT and KEYFORGE may use Microsoft-hosted synchronization services when those features are enabled. Squadron administrators are responsible for deciding what information is entered and who receives it.
5. Donations and Payments
SkyPilot, NORDEN II, and the published 3D model libraries are offered free of charge. Voluntary support through Buy Me a Coffee or PayPal is a donation toward continued development and does not purchase ownership, guaranteed support, or a particular future feature. Payment providers process payments under their own terms and privacy practices.
6. Availability, Updates, and Support
The Software may be updated, modified, suspended, or discontinued at any time. Support is provided on a reasonable-effort basis and is not guaranteed. Updates may change compatibility, features, data formats, or system requirements.
7. Disclaimer
THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW. USE IS AT YOUR OWN RISK. THE SOFTWARE IS FOR VIRTUAL AVIATION, ENTERTAINMENT, TRAINING, AND MISSION-PLANNING SIMULATION; IT IS NOT INTENDED FOR REAL-WORLD COMBAT, NAVIGATION, WEAPONS EMPLOYMENT, EMERGENCY RESPONSE, OR SAFETY-CRITICAL USE.
8. Limitation of Liability
To the maximum extent permitted by law, Ken Johnson will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, use, revenue, or opportunity arising from use of the Software. Where liability cannot be excluded, total liability will not exceed the amount you paid directly for the Software during the twelve months before the claim.
9. Termination
Your permission to use the Software ends if you materially violate these Terms. Upon termination, stop using and distributing the affected Software. Provisions concerning ownership, disclaimers, limitations of liability, and governing law survive termination.
10. Governing Law
These Terms are governed by the laws of the State of California and applicable United States law, without regard to conflict-of-law rules.
